The paper deals with the structural vagueness of the legal measures enacted by the Italian legislator to manage the Covid-19 pandemic. Can we demand more certain norms? Is personal liberty taken in due account by the legislator? The chapter on democratic legitimacy and the Court of Justice of the European Union (CJEU) focuses on whether the CJEU through judicial activism may be claimed to have established its jurisprudence beyond the bounds of democratic legitimacy. The paper analyses the multiple tax procedures to be developed by the different bodies of the Spanish Tax Authorities (tax management procedures, tax inspection procedures, tax collection and tax penalty procedures) in the case of appreciation of an alleged crime against the Public Treasury. To attain this goal, a study of the new Tax crime configuration after 2012´ criminal reform is carried out, as well as a study of Act 34/2015.

Abstract. ‘Law as power’ is a neglected topic in contemporary analytical jurisprudence. Attention has been paid, from Hart (and Kelsen) onwards, to normative powers. ‘Brute’ social power, however, and law’s relation to it, are, in post-Hartian jurisprudence, largely overlooked. The subject of this paper is the shape social power takes when the rule of the law is envisaged as an ethico-political ideal—I discuss, that is, the Rule of Law as a specific mode of the exercise of social power, and what is valuable in it. This chapter addresses the legal outlining of the supervisory review process. There is an apparent contradiction between principles-based insurance supervision on the one hand and, on the other hand, legal certainty along with foreseeability of supervisory action under art. 36 of the Solvency II Directive. With this in view, the chapter next examines the objectives and subject matter of the supervisory review process, with particular scrutiny given to requirements relating to solvency and governance. The powers of supervisory authorities to remedy weaknesses and deficiencies are then taken up.

The article presents the issue of trust in law as one of the fundamental values of a rule-of-law state. The analysis of the court rulings conducted in the first part of the article indicates the principle of a democratic rule-of-law state as a basis for distinguishing substantive and formal components of trust in law. Further considerations of the article focus on showing the change of law, in particular its transition from repressive law to responsive law, and the possible effects of this change on the paradigm of trust established in a democratic ruleof-law state. La Resolución 1624 (2005) del Consejo de Seguridad de las Naciones Unidas no define la incitación al terrorismo. Sí lo hace, por el contrario, el Convenio núm. 196 del Consejo de Europa de 2005 que caracteriza la provocación pública al terrorismo incluyendo deliberadamente la incitación indirecta, exigiendo una intencionalidad específica y un resultado de peligro de comisión de un delito terrorista.
